You have probably noticed that No identifiable faces<\/strong> of the children on my website or on social media.
FOR SURE<\/strong> I also take lots of photos <\/strong>on which the faces <\/strong>of the children are visible!<\/p>

I simply show these NOT online!\u00a0<\/strong><\/p>

The fact that I can still work successfully as a family photographer is shown by my various successful participations in international photography competitions such as the Fearless Family Awards<\/a>, the Documantary Family Awards<\/a> or the This is Reportage Family Awards<\/a>.\u00a0<\/p>

When our first child came into the world, we decided that it would be a good idea to give him or her SELF the choice<\/strong> what is online from him or her and what is not. In my opinion, however, this is only possible if the kid is old enough and by that I mean Legal age of majority<\/strong>.\u00a0<\/p>

In this context, a baby or toddler cannot logically decide for themselves at first. When the child gets older, he or she can make more of a decision, but what a schoolchild might find okay can be super unpleasant and embarrassing for a teenager.\u00a0<\/p>

Imagine how you would have felt as a teenager if your parents had shown you baby and toddler photos that you didn't like.\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

1.1 Right to one's own image<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

The right to one's own image is part of the general right of personality<\/strong>\u00a0and says that every human being is basically may determine for himself<\/strong>, whether and in what context photos of him or her may be published.<\/p>

A photo or video<\/strong> in which you are recognisably photographed<\/strong> may therefore only be published under certain conditions<\/strong> .\u00a0<\/p>

In Austria, this is regulated <\/span>in \u00a778 of the Copyright Act<\/a> .<\/span><\/p>

In Germany, it is on the one hand a sub-category of the general right of personality and is protected by artistic copyright law. \u00a722 of the Art Copyright Act<\/a> states \"portraits may only be distributed or publicly displayed with the consent of the person portrayed...\".\u00a0<\/p>

A Permission<\/strong> is required under the KUG if the person photographed is RECOGNISABLE<\/strong> .<\/p>

For children up to the age of seven, it only depends on whether the parents agree. For photos of children up to and including the age of 17, parental consent is also required, in addition, however, the minor must<\/strong> give permission. The exact point in time when the child has to give his or her additional consent depends on the child's capacity.<\/p>

And on the other hand, there is also the Data Protection Regulation (GDPR)<\/strong>.\u00a0<\/p>

Which law or regulation applies in Germany is depending on who took the photo<\/strong> for example, the GDPR is important if you are a photographer. \u00a0\u00a0<\/p>

Then there is the case that already the the taking of photographs ITSELF is prohibited<\/strong> You can even make yourself liable to punishment, for example in the case of photographs:<\/p>
